Terms of Use

These Terms of Use (the “Agreement”) constitute a legally binding agreement between you (“User”) and Dmitrii Groshev, owner of Dayrise App (“Provider”, “we”, “us”), governing your use of the mobile application Dayrise (the “App”). By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, you must not use the App.

1. Definitions

• App: the Dayrise mobile application distributed via the Apple App Store.
• User Content: any information, data, or material input by the User into the App, including habit names, notes, schedules, streaks.
• Services: features provided by the App, including free and paid habit tracking functionality, reminders, analytics, and integrations.
• Subscription: auto-renewable paid access to premium features for a period (e.g., monthly, yearly).
• Free Tier: the version of the App available without charge, with limited functionality.

2. License and Use

• Provider grants the User a personal, non-exclusive, non-transferable, revocable license to install and use the App solely for personal, non-commercial purposes.
• The User shall not:
  • copy, modify, distribute, sell, or lease the App or its parts;
  • reverse engineer or decompile the App, except as permitted by law;
  • use the App for unlawful, harmful, or abusive purposes.

3. Services and Subscriptions

• The App provides both free and paid functionality.
• Paid features are available through auto-renewing subscriptions (e.g., Monthly, Yearly) or one-time purchases. Pricing and available plans are displayed within the App and may vary by region.
• Subscriptions are billed via the User’s Apple ID. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Free trials (if offered) convert into paid subscriptions unless canceled before expiration. Only one trial per Apple ID is permitted.
• Refunds are handled exclusively by Apple under its refund policies.

4. User Content

• The User remains the sole owner of their User Content.
• By using the App, the User grants Provider a non-exclusive, royalty-free license to process, store, and display User Content solely for the purpose of operating the App.
• Provider does not sell or share User Content with third parties.

5. Health & Wellness Disclaimer

• The App is designed for habit tracking and self-organization.
• The App does not provide medical advice. For health-related decisions, the User must consult qualified professionals.

6. Privacy and Data

• Provider processes personal data in accordance with the Privacy Policy.
• Health data (via Apple HealthKit) is accessed only with explicit consent. Such data is not used for advertising, shared, or sold.
• Analytics (Amplitude) may be used for anonymous usage statistics. No personal identifiers are collected or transmitted.

7. Intellectual Property

• The App, its design, graphics, source code, and content are owned by Provider.
• All rights not expressly granted to the User remain with Provider.

8. Termination

• Provider may suspend or terminate access to the App in case of violation of this Agreement or misuse of the App.

9. Liability and Indemnification

• The App is provided “as is” without warranties of any kind.
• To the maximum extent permitted by law, Provider’s liability is limited to amounts paid by the User during the 12 months preceding the claim.
• The User agrees to indemnify and hold harmless Provider against claims or damages resulting from misuse of the App or violation of this Agreement.

10. Changes to Terms

• Provider may amend these Terms at any time. The updated version will be published in the App and on https://drise.app/terms. Continued use of the App after changes constitutes acceptance.

11. Apple EULA

• If obtained via the Apple App Store, these Terms supplement, and do not replace, Apple’s Standard End User License Agreement (EULA). In case of conflict, Apple’s EULA prevails.

12. Governing Law

• This Agreement shall be governed by and construed in accordance with the laws of Georgia
